Filing a Lawsuit Without the Defendant’s National ID Number

The absence of the defendant’s national ID number does not constitute an impediment to registering a lawsuit when obtaining such information is not possible. This is pursuant to the decision of the Supreme Judicial Council No. (10) dated 03/02/1441H, which permits the acceptance and consideration of a claim despite the lack of such data, in order to safeguard the right to litigation and prevent its obstruction due to formal or procedural reasons.

In this context, the claimant may pursue one of the following two avenues:

  1. Through the Najiz platform, by submitting a support ticket and requesting to be provided with the defendant’s details in accordance with the referenced decision.
  2. Directly through the court, where the lawyer may register the claim while explaining the inability to obtain the national ID number and request its acceptance in accordance with the law without entering it.

The court retains the authority to take any measures it deems appropriate to verify the defendant’s identity through the competent authorities.
